New State Law Authorizes Network Pharmacies to Offer Lower-Cost Prescription Drug Options

Governor Phil Murphy signed S3604 into law as P.L.2023, c.221., which authorizes the use of healthcare platforms providing discounted prices for payment of prescription and non-prescription drugs, devices, and telehealth and telemedicine services.

This law prohibits pharmacy benefit managers (PBMs) from hindering, imposing penalties, or disincentivizing network pharmacies from offering consumers reduced prices offered by other healthcare platforms.

Under this law, which went into effect immediately upon its signing, individuals with accounts with healthcare platforms such as GoodRx and SingleCare, will have access to reduced prices when purchasing prescription drugs. Such individuals would also be able to apply their healthcare platform memberships toward the payment of telehealth and telemedicine services.
